Partnership-Plussm Membership Terms

Eligibility for Participation

The Partnership-Plus program is owned and operated by The NPD Group, Inc. (the "Sponsor"). Membership and its benefits are offered at the discretion of Sponsor.

Residents of the United States, age 13 or older, may participate in Partnership-Plus. Residents of Maine under the age of 18, employees of the Sponsor, members of their households or immediate families are not eligible to participate. In addition, individuals who are employed in marketing research or who have members of their households employed in marketing research are not eligible. Individuals who are 13 to 17 years old may participate with permission of a parent, however residents of Maine under the age of 18 may not participate even with parental consent. No more than one member per household is permitted.

To ensure that the Partnership-Plus program includes segments of the US population in their correct proportion, participation by certain population segments occasionally may be filled and closed to new members.

Conditions

By participating in the program, each member of Partnership-Plus agrees to be bound by these Membership Terms and the decisions of the Sponsor. The Sponsor, agents and representatives of the Sponsor, its promotion and fulfillment agencies and legal advisors are not responsible for and shall not be liable for 1) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind; 2) lost or misdirected communications; 3) failed, incomplete, garbled or delayed computer transmissions; 4) any condition caused by events beyond the control of the Sponsor that may cause the program to be disrupted or corrupted; 5) any injuries, losses or damages of any kind arising in connection with or as a result of a reward, or acceptance, possession or use of the reward or from participation in the program; 6) any printing or typographical errors in any materials associated with the program. Sponsor reserves the right, in its sole discretion, to suspend or cancel the program at any time if a computer virus, bug or other technical problem corrupts the proper administration or security of the program.

The Sponsor is not liable for any Partner-Points awarded inaccurately by a failure such as those defined above.

By participating in Partnership-Plus and the Partner-Points Rewards program, each member agrees to release and hold the Sponsor and its parents, subsidiaries, employees, officers, directors, agents, representatives of the Sponsor, its advertising, promotion and fulfillment agencies and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the program or resulting from acceptance, possession or use of any reward, including without limitation, personal injury, death, and property damage and claims based on publicity rights, defamation or invasion of privacy.

Members shall have no property interest or other rights with respect to any communication members make to the Sponsor regarding the Partnership-Plus program and Partner-Points, including, but not limited to feedback, questions, comments or suggestions, and the Sponsor may reproduce, use, disclose or communicate such information in its sole discretion consistent with our privacy policy.

Use of Website and Other Materials

The Partnership-Plus web site, information displayed on the website and all written materials related to Partnership-Plus are the exclusive property of Sponsor and are only made available for members' personal, non-commercial use. Members may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this website. No license to or right in any trademark, service mark, copyrighted material or other proprietary information of Sponsor is granted to or conferred upon members.

Program Duration/Modification

Participation in the Partnership-Plus program is subject to the terms and conditions, rules, regulations and procedures that Sponsor establishes.

Partnership-Plus reserves the right to improve, modify or terminate the program, including the Partner-Points Rewards Program, at its sole discretion at any time with or without advance notice to any program member. Modifications may include, but are not limited to, changes to surveys, additions or deletions to the list of rewards for which points may be redeemed, point accumulation methods or modifications to point values for existing methods of earning points. Partnership-Plus may, but shall not be required to alert its membership about any changes on or before the effective date. Accrued Partner-Points do not constitute property of the member. In the event of program termination, Partner-Points will not be redeemable.

Discontinuation of Participation

Account Termination Initiated by Member: Partnership-Plus appreciates member participation, which is vital to the success of this important study, and prefers each member to remain part of its "community". However, members who would like to terminate from the program may unsubscribe at any time by:

Members wishing to redeem Partner-Points must do so prior to termination from the program, as points remaining in an account will be forfeited at the time members terminate from Partnership-Plus.

Account Termination Initiated by Sponsor:

The success of Partnership-Plus depends on hearing from each of its members on a regular basis. Therefore, the accounts of any members who do not respond to monthly surveys for a period of four consecutive months will be considered inactive and the membership may be terminated at the discretion of Sponsor.

The success of Partnership-Plus also depends on its members providing information that is accurate and complete. In addition, each individual may have only one Partnership-Plus membership. If, in the judgment of Partnership-Plus, a member has provided false information, or has misrepresented him or herself in a way that is deemed to be detrimental to the program, or is or becomes ineligible for participation as a member, Partnership-Plus reserves the right to terminate the membership without advance notice.

From time to time, to maintain desired sample quality and balancing, Partnership-Plus may need to terminate selected members' accounts. In most cases, members will be notified in advance that their membership will be terminated and will be given the opportunity to redeem any Partner-Points in their account prior to termination. However, Partnership-Plus reserves the right to terminate any membership, at any time, with or without advance notice.

Partnership-Plus and Partner-Points are servicemarks of Sponsor.

Participation in Partnership-Plus implies acceptance of the terms of membership. If you do not accept these terms, please ask to be removed from the program.
